1. Acceptance of Terms
By accessing or using the WhoIsAtTop platform (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must not use the Platform.
These Terms apply to all visitors, registered users, and businesses that access or use our services. By creating an account or submitting content, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms.
We reserve the right to update these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.
2. Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform in any way that violates applicable laws, infringes on the rights of others, or disrupts the operation of the Platform.
Prohibited activities include, but are not limited to: submitting false or misleading reviews, attempting to manipulate business ratings, using automated tools to scrape or access the Platform without authorization, and impersonating any person or entity.
We reserve the right to suspend or terminate access to any user who violates these Terms or engages in conduct we deem harmful to the Platform, our users, or third parties.
3. User Accounts
To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate and complete information when creating your account. You must promptly update your account information if it changes. You may not share your account with others or create multiple accounts for fraudulent purposes.
If you believe your account has been compromised, you must notify us immediately at security@whoisattop.com. We are not liable for any loss arising from unauthorized use of your account.
4. Reviews and Content
By submitting a review or any other content to the Platform, you grant WhoIsAtTop a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content in connection with our services.
Reviews must reflect your genuine firsthand experience with a business. You must not submit reviews in exchange for payment, discounts, or any other incentive. You must not submit reviews for businesses you are affiliated with.
We reserve the right to remove any content that violates these Terms, our content guidelines, or applicable law. Repeated violations may result in permanent account termination.
5. Business Accounts
Businesses that claim a profile on WhoIsAtTop agree to additional terms applicable to business users. Business accounts must represent an actual, operating business and must be managed by an authorized representative.
Businesses may respond to reviews posted about them, but may not attempt to remove, suppress, or manipulate legitimate reviews through any means. Any attempt to game the review system will result in penalties, including reduced visibility or removal from the Platform.

6. Intellectual Property
The Platform, including its software, design, trademarks, and content created by WhoIsAtTop, is owned by WhoIsAtTop Technologies Pvt. Ltd. and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on our Platform or content without our express written permission. Limited use of publicly available review content for non-commercial journalistic purposes may be permitted with proper attribution.
The WhoIsAtTop name, logo, and associated marks are registered trademarks. Unauthorized use is prohibited.
7. Disclaimer of Warranties
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
We do not endorse or verify the accuracy of reviews or business information on the Platform. User-generated content reflects the opinions of individual users and does not represent the views of WhoIsAtTop.
To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the fullest extent permitted by applicable law, WhoIsAtTop and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Our total liability for any claim arising out of or related to these Terms or the Platform shall not exceed the greater of INR 1,000 or the amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow the limitation of liability for personal injury or certain other damages, so some of the above limitations may not apply to you.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
If you are using the Platform from outside India, you are responsible for compliance with your local laws. Nothing in these Terms limits any rights you may have under applicable mandatory consumer protection laws in your jurisdiction.
10. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will notify you by email or by posting a prominent notice on the Platform prior to the changes taking effect.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree with the updated Terms, you must stop using the Platform.
